Client Profile and Impairments:
Roberta and David were married and both disabled although they suffered from different impairments. Roberta, 61, couldn’t keep up with the standing, walking, and lifting requirements of full-time work. She suffered from serious complications relating to her arthritis, back problems and a diagnosis of carpal tunnel syndrome.
Roberta’s husband David, 62, suffered a stroke with resulting memory loss and suffered from severe arthritis in his back and shoulder. Due to the complications from his stroke and his arthritis, he had trouble physically performing work duties like standing, walking, and lifting. His memory loss also made it hard for him to perform detailed tasks.

Roberta and David hired us soon after they stopped working. Roberta’s claim was first, and David initiated his claim approximately one year later when he experienced a stroke. SSA approved Roberta’s and David’s claims for benefits at the initial stage of the process. However in both claims, SSA made significant changes in the effective date of their claims, taking away all back pay.
Our Social Security Disability attorneys felt strongly that these changes were unfair and unwarranted. As a result, we appealed both claims all the way to hearings with an administrative law judge (ALJ). We argued that the evidence established a much earlier onset date and asked for more than a year of retroactive benefits in each case.
The ALJs for both Roberta and David agreed with our arguments and awarded significant backpay for each claim. Roberta received more than $20,000 in retroactive benefits and David received more than $38,000 as well as their monthly benefit payments for life. In addition, they receive health insurance through Medicare.
